Terms of Service

You must be at least 16 years old to use the Service. By creating an account, you confirm that you meet this requirement. If we learn an account does not meet this requirement, we may suspend or terminate it.

You're responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly at darren.sutton@benevolai.co.uk if you suspect unauthorized access.

• Pricing and billing frequency are shown before you confirm a purchase. Subscriptions renew automatically at the end of each billing period unless cancelled.
• Cancellation: you can cancel at any time from your account settings, through the same method you used to subscribe. Cancellation takes effect at the end of the current billing period unless we state otherwise.
• Free trials: if offered, we'll show the conversion date and price clearly before you start, and your payment method will be charged automatically at the end of the trial unless you cancel beforehand.
• Price changes: we'll give you at least 30 days' notice before a price increase takes effect on your next renewal. Continuing to use the Service after that point constitutes acceptance of the new price.
• Refunds: subscriptions are non-refundable except as required by applicable law. Nothing here limits any statutory refund or cancellation right you have under the law of your country of residence, including EU/UK consumer rights for digital services.

• Certain features use artificial intelligence to generate responses or content based on your input. AI-generated output may be inaccurate, incomplete, or inappropriate for your purpose — you're responsible for evaluating it before relying on it. The Service is not a substitute for professional advice.
• You retain rights to the input you submit. Output generated in response to your input is yours to use, subject to Anthropic's usage policies.
• You agree not to use AI features to generate content that is illegal, infringing, or that violates Section 6 (Acceptable Use) below.
• We clearly indicate when you're interacting with an AI system rather than a human.

You retain ownership of content you submit to the Service ("Your Content"). You grant us a licence to host, store, and process Your Content as necessary to provide the Service (including sending it to Anthropic where you use AI features). You're responsible for Your Content and confirm you have the right to submit it.

You agree not to:

• Use the Service for any illegal purpose, or to violate any third party's rights
• Attempt to gain unauthorised access to the Service or other users' accounts
• Use the Service to generate or distribute content that is fraudulent, defamatory, harassing, or that infringes intellectual property rights
• Reverse-engineer, scrape, or attempt to extract the underlying models or source code of the Service
• Use the Service to build a competing product without our written permission

We may suspend or terminate accounts that violate this section.

The Service, including its design, software, and branding (excluding Your Content), is owned by BenevolAI Limited (Promptally) or our licensors. These Terms don't grant you any rights to our intellectual property beyond what's needed to use the Service as intended.

The Service relies on third-party providers, including Stripe (payments), Anthropic (AI), Vercel (hosting), and PostHog (analytics). We're not responsible for the availability or performance of these third-party services, though we select providers we consider reputable and contract with them to protect your data (see our Privacy Notice).

The Service is provided "as is" without warranties of any kind, to the maximum extent permitted by law. We don't guarantee the Service will be uninterrupted, error-free, or that AI-generated output will be accurate. Nothing in this section excludes liability that cannot be excluded under applicable law, including UK/EU/Australian consumer protection law.

To the maximum extent permitted by law, BenevolAI Limited (Promptally) will not be liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose. This limitation does not apply where prohibited by law, including for liability arising from death, personal injury, fraud, or other matters that cannot be limited under the law of your country of residence.

You agree to indemnify BenevolAI Limited (Promptally) against claims arising from your violation of these Terms or misuse of the Service, to the extent permitted by applicable law.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, with notice where reasonably practicable. Sections that by their nature should survive termination (intellectual property, limitation of liability) will continue to apply.

We may update these Terms from time to time. For material changes, we'll provide notice (for example, by email or in-app notification) before they take effect. Continued use after changes take effect constitutes acceptance.

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles, except that nothing here overrides mandatory consumer protection rights you have under the law of your own country or state of residence, which continue to apply regardless of this clause.
